Right now, Elon Musk’s lobbyists are pressuring Texas House Representatives to vote on House bills that give Elon Musk’s company town, “Starbase,” primary control over Boca Chica Beach and criminalize beachgoers. These bills are HB 4660/SB 2188 and HB 4661/SB 2230. Right now, you can take action to stop House Bill 4660/SB 2188, which, if passed, would allow “Starbase” primary control over access to Boca Chica beach. The other bill we must stop, House Bill 4661, if passed, would slap Boca Chica beachgoers with aggressive criminal charges such as Class B or A misdemeanors that could mean serious jail time.
Election day for Starbase’s vote to incorporate into a town is May 3rd. This incorporation election is unfair, as only about 200 people are eligible to vote, most of whom are SpaceX staff.
Why is this bad? Boca Chica Beach is meant for the people, not Elon Musk to control. For generations, residents have visited Boca Chica beach for fishing, swimming, recreation, and the Carrizo/Comecrudo Tribe has spiritual ties to the beach. They should be able to keep access. Since SpaceX operations began in 2021, it’s become extremely difficult to determine when the beach will be open to the public due to SpaceX operations. Residents should not be penalized for visiting the beach they’ve been visiting their entire lives. For example, on April 29, 2025, SpaceX conducted rocket testing, but no alert was sent to the public to notify them of a beach closure.
What is the status of the bills? SB 2188 was initially killed on Monday, April 28. Unfortunately, the bill was revived by a revote, and this bill, along with HB 4661, has been passed along to the Texas House Representatives’ Calendars Committee. We must defeat these bills by urging the House Representatives to vote no. Update: Good news, HB 4660 is dead!
